§ 1 Vertragspartner
Metallbau Hanau GmbH not only acts as an intermediary, but also often handles delivery itself with its own tank fleet. Through our website, we connect heating oil consumers with our partner dealers and also offer our own flexible delivery service. This allows our customers to benefit from both ordering directly from our partner dealers and reliable delivery through our own network.
Purchase contracts and any claims arise primarily between the partner dealer and the purchaser/user. If Metallbau Hanau GmbH acts as the supplier itself, we ensure smooth processing and timely delivery.
§ 2 Vertragsabschluß
By clicking the “Buy now” button, you place a binding order for the selected product. You will receive confirmation of receipt of your order immediately after submitting it.
The purchase contract between the user and Metallbau Hanau GmbH or one of our partner retailers is only concluded upon receipt of an order confirmation via email or telephone outside of our platform. This confirmation will be sent within 5 days at the latest.
§ 3 Widerruf
Beim Kauf von Heizöl besteht kein gesetzliches Widerrufsrecht, da diese Lieferungen von Schwankungen auf den Energie- und Rohstoffmärkten abhängig sind. Gemäß § 312g Abs. 2 Nr. 8 BGB ist das Widerrufsrecht für Verbraucher ausgeschlossen, Willenserklärungen auf Abschluss eines Kaufvertrages können daher nicht widerrufen werden.
§ 4 Preise und Lieferbedingungen
Der Rechnungsbetrag wird auf Basis der angegebenen Liefermenge berechnet. Weicht die tatsächlich abgenommene Menge um mehr als 10 % nach unten ab, kann der Partnerhändler den Preis entsprechend anpassen. Bei Sammelbestellungen gilt das Preisangebot nur, wenn die Lieferstellen maximal 15 km voneinander entfernt sind. Eine Schlauchlänge über 40 Meter oder erschwerte Lieferbedingungen müssen bei der Bestellung angegeben werden. Die gelieferte Heizölmenge wird durch einen geeichten Durchlaufzähler am Tankwagen temperaturkompensiert auf 15 °C ermittelt und abgerechnet.
§ 5 Zahlung auf Rechnung
If the user is offered the payment option ” invoice ” or ” cash on delivery ,” this is subject to a positive credit check by our partner dealer or Metallbau Hanau GmbH. For new customers, a deposit of 50% of the order value is required.
§ 6 Systemausfall
Metallbau Hanau GmbH does not guarantee the constant and uninterrupted availability of the website and the ordering system, nor does it accept liability for any damages that may arise from this.
§ 7 Marktinformationen - rechtliche Hinweise
Metallbau Hanau GmbH reserves all rights to the published market information, charts, and prices. Storage in databases, publication, reproduction, or distribution to third parties, as well as any commercial use, are prohibited without express written consent. Despite careful research, no liability can be assumed for the accuracy of the information.
§ 8 Allgemeine Haftung und Gewährleistung
Metallbau Hanau GmbH assumes no liability or warranty for contracts between users and partner retailers. In particular, we are not liable for the characteristics, quality, or availability of the agreed services, nor for direct or consequential damages. By submitting a binding order, users confirm that their information is true and complete. Metallbau Hanau GmbH reserves the right to verify this information at any time through its own research.
§ 9 OS-Plattform für Streitfrage
Alternative Streitbeilegung gemäß Art. 14 Abs. 1 ODR-VO und § 36 VSBG:
Die Europäische Kommission stellt eine Plattform zur Online-Streitbeilegung (OS) unter https://ec.europa.eu/consumers/odr/ bereit. Wir sind weder verpflichtet noch bereit, an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
